You can find almost anything in a South Dakota pantry, but these five items are the exception. Whether it's due to federal safety standards or international wildlife protection, certain foods are banned across the state.

Before you accidentally break the law over a snack, here are five surprising foods you won't find in the Mount Rushmore State.

They may look harmless, but the ban on these is pretty obvious. Kinder Surprise Eggs have been banned in South Dakota since a 1938 Federal Law was put into effect due to choking hazards. While the Kinder Surprise Egg isn't an option here in the US, the Kinder Joy was specifically created for the US market. It's legal because the toy and the food are in two separate halves.

In 2023, the Shark Fin Sales Elimination Act became official federal law. It doesn't matter if you're thousands of miles from the ocean; in South Dakota, this soup is officially off the menu.

South Dakota has long been a leader in the cattle industry, and the state legislature is making sure it stays that way. Starting July 1, 2026, a new law goes into effect, placing a five-year moratorium on the sale and distribution of cell-cultured protein. This pause is designed to protect our local ranchers and ensure that the beef on South Dakota tables continues to come from the pasture, not the lab.

Haggis

For over 50 years, traditional haggis has been banned in the U.S. because the USDA considers sheep lungs "unfit for human consumption." However, in late 2025 and into 2026, Scottish producers have started creating a "U.S. Legal" version that swaps the lungs for other ingredients while keeping the flavor.

Beluga Caviar

This one might be a bit surprising. While the ban started in 2005 to protect the endangered Beluga sturgeon, the "import" side has gotten even tighter in 2026. As of January 1, new NOAA fisheries rules have made it even harder to bring in any seafood products from countries that don't meet strict U.S. conservation standards.
