The short answer is no, it is not illegal. The longer answer could be a lot more complicated. Thanks to the "Bizarre Hobby" website, which deals with dumpster diving in all its weird glory, some of the finer points of this activity have been distilled down for us.

There are no laws in South Dakota preventing people from doing some extra-curricular shopping in dumpsters. But there are trespassing laws and there also may be local ordinances you need to be aware of.

If you go dumpster diving without first asking for permission, you could be charged with trespassing. In most municipalities, there are no regulations banning dumpster diving on public property.

But, to be clear- - you are responsible for checking local, county, and state ordinances on this subject.

According to Find Law, trespassing is a tricky thing because many areas that you might consider to be public are not. So again, if someone can charge you with trespassing, is it worth rummaging through a dumpster?
